Terms of Use

These Terms of Use (“Terms”) govern your access to and use of the Saturday Poll mobile application and related services (collectively, the “Service”). By using the Service, you agree to these Terms.

1. Eligibility

You must be at least 13 years old to use the Service. If you are under the age of legal majority where you live, you may use the Service only with permission from a parent or legal guardian.

2. Accounts

You may use a guest account or create an account using an available sign-in method. You are responsible for providing accurate information, safeguarding your credentials, and all activity under your account. Notify us promptly if you suspect unauthorized access. You may delete your account from the Profile screen in the App.

3. Acceptable use

You agree not to:

• use the Service unlawfully, fraudulently, or to harm another person;
• attempt to gain unauthorized access to the Service or another user’s account;
• interfere with, overload, reverse engineer, or circumvent the Service or its security features, except where applicable law permits;
• use automated means to scrape, extract, or manipulate data or poll results without permission;
• submit malicious code or impersonate another person; or
• use the Service to infringe intellectual property, privacy, or other rights.

4. Polls and user activity

The Service lets users create rankings and make selections that may contribute to aggregated community results. Polls are for entertainment and informational purposes. We may establish deadlines, eligibility rules, or methods for calculating results and may correct errors or exclude activity reasonably believed to be fraudulent or abusive.

5. College sports information

Scores, records, rankings, schedules, team information, and other sports data may come from third parties and may be delayed, incomplete, or inaccurate. Saturday Poll is an independent product and is not endorsed by or affiliated with the NCAA, any conference, school, team, poll publisher, or Apple. Team names and marks belong to their respective owners.

6. Intellectual property

The Service, including its software, design, text, and original graphics, is owned by Saturday Poll or its licensors and is protected by law. Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable license to use the Service for noncommercial purposes.

7. Feedback

If you provide ideas or feedback, you grant us permission to use them without restriction or compensation, but you are not required to provide feedback.

8. Third-party services

The Service may rely on or link to third-party services. We do not control and are not responsible for third-party services, which may be governed by separate terms and policies.

9. Changes and availability

We may modify, suspend, or discontinue any part of the Service, and the Service may occasionally be unavailable. We may update these Terms by posting a revised version and changing the “Last updated” date. Continued use after the revised Terms take effect constitutes acceptance where permitted by law.

10. Termination

You may stop using the Service at any time. We may suspend or terminate access if you violate these Terms, create risk or legal exposure, or if the Service is discontinued. Provisions that by their nature should survive termination will survive.

11. Disclaimers

To the fullest extent permitted by law, the Service is provided “as is” and “as available.” We disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, non-infringement, and accuracy. Nothing in these Terms excludes warranties that cannot legally be excluded.

12. Limitation of liability

To the fullest extent permitted by law, Saturday Poll and its owner, affiliates, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, data, goodwill, or opportunities, arising from the Service. Our total liability for all claims relating to the Service will not exceed the greater of $100 or the amount you paid us to use the Service during the 12 months before the claim. Some jurisdictions do not allow certain limitations, so they may not apply to you.

13. Apple terms

If you download the App from Apple’s App Store, you acknowledge that these Terms are between you and Saturday Poll, not Apple. Apple has no obligation to provide maintenance or support. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you. Your use of the App must comply with the App Store’s applicable terms.
